MEL Entertainment Ltd trading as Bear Grylls Survival Academy (BGSA)
These Terms & Conditions apply to all bookings made with Bear Grylls Survival Academy (BGSA). Together with the Booking Confirmation, they form the contract between BGSA and the Client.
1. Definitions
BGSA means MEL Entertainment Ltd trading as Bear Grylls Survival Academy. Client means the organisation or individual booking the services. Event means the activity, programme, or experience delivered by BGSA. Services means the activities and event services provided by BGSA as set out in the Booking Confirmation.
2. Booking and Contract
A booking is confirmed when the Client accepts a quotation or signs the Booking Confirmation. Once confirmed, the booking becomes a binding agreement governed by these Terms & Conditions.
3. Services
BGSA will deliver the Services described in the Booking Confirmation using reasonable care, skill and professionalism. BGSA may use subcontractors or partner providers where necessary to deliver elements of the Event.
4. Adventure Activities and Risk
BGSA delivers adventure and survival activities which may involve physical activity, outdoor environments and unpredictable conditions. Participation in these activities involves inherent risks including slips, trips, falls, environmental hazards and physical exertion. Participants take part voluntarily and must follow all instructor safety instructions.
5. Participant Requirements
The Client must ensure all participants complete any required acknowledgement of risk, medical declaration or indemnity forms before taking part in activities. Participants must inform BGSA of any relevant medical conditions or allergies.
6. Client Responsibilities
The Client must provide accurate information regarding participant numbers, event location and relevant requirements. The Client is responsible for participant behaviour and ensuring participants follow instructor instructions.
7. Changes to Bookings
If the Client requests changes to the Event scope, date, location or programme, BGSA will assess the request and confirm whether changes can be accommodated. Additional charges may apply.
8. Payment Terms
A non-refundable deposit of 25% is required to secure a booking. The remaining balance must be paid no later than 60 days before the Event unless otherwise agreed. If the Event is booked within 60 days of the Event date, full payment is required at the time of booking.
9. Cancellation Policy
If the Client cancels the booking, the following charges apply:
• More than 60 days before the Event: 25% of the total fee
• Between 60 and 30 days before the Event: 50% of the total fee
• Less than 30 days before the Event: 100% of the total fee
10. Safety and Weather
BGSA reserves the right to modify or cancel activities where weather conditions, safety concerns, or environmental factors make delivery unsafe. Where possible BGSA will provide alternative activities.
11. Liability
Nothing in these Terms limits liability for death or personal injury caused by negligence. Subject to this, BGSA shall not be liable for indirect or consequential losses, including loss of profits or business.
12. Insurance
BGSA maintains appropriate public liability insurance for events and activities. Evidence of insurance can be provided upon request.
13. Intellectual Property
All intellectual property relating to BGSA activities, materials and programme design remains the property of BGSA.
14. Confidentiality
Both parties agree to keep confidential any commercial or operational information obtained during the course of the Event.
15. Force Majeure
BGSA shall not be liable for failure to perform its obligations where this is caused by events beyond its reasonable control including extreme weather, natural disasters, government restrictions or transport disruption.
16. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
